RE: The tariff classification of a woman’s knit jacket from various countries.

Dear Mr. Woltmann:

In your letter dated May 24, 2007 you requested a classification ruling on behalf of your client Fuda International Ltd. As requested, your sample is being returned to you.

The submitted sample, style FW5577SK132, is a woman’s jacket made from 60% cotton and 40% polyester knitted fabric. The jacket features a full front opening with a zipper closure, two patch pockets at the waist, long sleeves with rib knit cuffs, a rib knit waistband, and a hood that can be tightened by means of a drawstring. The hood and front and back panels have a thick 100% polyester knit pile lining. The sleeves are lined with a knitted fabric.

The applicable subheading for the jacket will be 6102.20.0010, Harmonized Tariff Schedule of the United States (HTSUS), which provides for women’s or girls’ overcoats, carcoats, capes, cloaks, anoraks (including ski-jackets), windbreakers and similar articles, knitted or crocheted, other than those of heading 6104: of cotton: women’s. The duty rate will be 15.9%.

The jacket falls within textile category 335. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. The textile category number above applies to merchandise produced in non-WTO member-countries. Quota and visa requirements are the result of international agreements that are subject to frequent renegotiations and changes. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
