RE: The tariff classification of Animal Caller from China

Dear Ms. Sudsinsunthorn:

In your letter dated May 22, 2007, you requested a tariff classification ruling.

The sample submitted, Animal Caller is a toy blow horn measuring approximately 4.62 inches by 4.19 inches by 10.00 inches. It is an electronic toy that will play an animal sound. The toy allows a child to activate and control the sound coming out of the toy by blowing harder and longer. The animal caller is comprised of 95% plastic and 5 % electronic components. The toy is put up for the amusement of children.

The applicable subheading for the Animal Caller will be 9503.00.0080, Harmonized Tariff Schedule of the United States (HTSUS), which provides for Other toys; reduced-size ("scale") models and similar recreational models, working or not; puzzles of all kinds; parts and accessories thereof: Other: Other. The rate of duty will be Free.
