RE: The tariff classification of a woman’s knit garment from Mexico

Dear Mr. Aives:

In your letter dated May 21, 2007, you requested a tariff classification ruling. As per your conversation with Anna Maria Bastone, this ruling is on behalf of Cintas. The provided sample is being returned as per your request.

Style 82034-01 is a woman’s cut and sewn short sleeve pullover made of 100% acrylic knit fabric whose outer surface measures more than 9 stitches per 2 centimeters in the direction in which the stitches are formed. The garment features a ribbed knit collar and a ribbed knit finish at the cuffs and garment bottom.

The applicable subheading for style 82034-01 will be 6110.30.3059, Harmonized Tariff Schedule of the United States (HTSUS), which provides for sweaters, pullovers, sweatshirts, waistcoats (vests) and similar articles, knitted or crocheted: of man-made fibers: other: other: other: Women’s: other. The rate of duty will be 32%.

Style number 82034-01 falls within textile category 639. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. The textile category number above applies to merchandise produced in non-WTO member-countries. Quota and visa requirements are the result of international agreements that are subject to frequent renegotiations and changes.
