RE: The tariff classification of men’s woven pants from Hong Kong.

Dear Mr. Spadaro:

In your letter dated May 9, 2007, you requested a tariff classification ruling on behalf of Generra / Public Clothing Corporation of New York. As requested, your sample will be returned.

Style M3024TM is a pair of men’s pants constructed from 53% cotton, 28% wool, 19% polyester, woven fabric. The pants have a flat waistband with four belt loops, a fly front opening with a covered placket and two button closures, two buttons at the waistband, quarter pockets at each side, two rear patch pockets with single button closures, and hemmed legs.

You have stated that the fabric contains compact yarns. Consequently, the applicable subheading for Style M3024TM will be 6203.42.4003, Harmonized Tariff Schedule of the United States (HTSUS), which provides for men’s or boys’ trousers, bib and brace overalls, breeches and shorts: of cotton: other: other: containing compact yarns contained in statistical reference numbers 5205.42.0021, 5205.43.0021, 5205.44.0021, 5205.46.0021 or 5205.47.0021. The duty rate is 16.6% ad valorem.

Style M3024TM falls within textile category 347. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. The textile category number above applies to merchandise produced in non-WTO member-countries. Quota and visa requirements are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information on quota and visa requirements applicable to this merchandise, we suggest you check, close to the time of shipment, the “Textile Status Report for Absolute Quotas” which is available on our web site at www.cbp.gov. For current information regarding possible textile safeguard actions on goods from China and related issues, we refer you to the web site of the Office of Textiles and Apparel of the Department of Commerce at otexa.ita.doc.gov.

The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
