RE: The tariff classification of women’s suit-type jackets from various countries

Dear Ms. Chioccola:

In your letter dated May 8, 2007, you requested a classification ruling. Your samples will be returned as requested.

Submitted sample, style #6164, is a woman’s suit-type jacket constructed from 100% acrylic woven fabric. The fully lined jacket extends from the shoulders to the waist and features a collar, long sleeves and an off center full front opening secured by one button and a snap closure.

Submitted sample, style #6196, is a woman’s suit-type jacket constructed from 62% polyester, 34% rayon and 4% spandex woven fabric. The fully lined jacket features a round neckline, long sleeves with ruffled cuffs, a full front opening secured by three buttons, shoulder pads and a ruffled bottom.

The applicable subheading for styles 6164 and 6196 will be 6204.33.5010, Harmonized Tariff Schedule of the United States (HTSUS), which provides for women’s or girls’ suits, ensembles, suit-type jackets, blazers, dresses, skirts, divided skirts, trousers, bib and brace overalls, breeches and shorts (other than swimwear): suit-types jackets and blazers: of synthetic fibers: other: women’s. The duty rate will be 27.3 percent ad valorem.

Styles 6164 and 6196 fall within textile category 635. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. The textile category number above applies to merchandise produced in non-WTO member-countries. Quota and visa requirements are the result of international agreements that are subject to frequent renegotiations and changes.
