RE: The tariff classification of a men’s knit pullover garment from India.

Dear Ms. McKnight:

In your letter dated April 25, 2007, you requested a tariff classification ruling on behalf of Christian Casey LLC. As requested, your sample will be returned.

Style HK6-502 is a men’s pullover garment constructed from 100% cotton, finely knit waffle fabric that measures 30 stitches per 2 centimeters counted in the horizontal direction. Style HK6-502 features a rib knit crew neckline; a triangular insert at the front neckline; long, raglan sleeves with rib knit cuffs; an embroidered logo on the left chest; rib knit inserts at each side; a woven fabric label sewn into the right side seam; and a straight, hemmed bottom.

The applicable subheading for Style HK6-502 will be 6110.20.2069, Harmonized Tariff Schedule of the United States, (HTSUS), which provides for: sweaters, pullovers, sweatshirts, waistcoats (vests) and similar articles, knitted or crocheted: of cotton: other: other: other: men's or boys': other. The duty rate is 16.5% ad valorem.

Style HK6-502 falls within textile category 338. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries.
