RE: The tariff classification of CARBOplatin Injection (aqueous solution) (10 mg/mL) from India

Dear Ms. Demkowicz:

In your letter dated April 12, 2007, you requested a tariff classification ruling.

The subject product, CARBOplatin Injection (aqueous solution) (10 mg/mL), is an injectable medicament, supplied in 5 mL, 15 mL, and 45 mL multi-use vials, consisting of Carboplatin (CAS-41575-94-4), an antineoplastic drug, in aqueous solution.

The applicable subheading for the subject product will be 3004.90.9115, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Medicaments consisting of mixed or unmixed products for therapeutic or prophylactic uses, put up in measured doses or in forms or packings for retail sale: Other: Other: Other: Antineoplastic and immunosuppressive medicaments.” The rate of duty will be free.
