RE: The tariff classification of a woman’s tank top from China.

Dear Ms. Allen:

In your letter dated April 11, 2007, you requested a classification ruling for a woman’s tank top.

The submitted sample, Style #H313, is a woman’s tank top constructed from 100% cotton rib knit fabric. The garment extends below the waist and features a U-shaped neckline in front and back, shoulder straps measuring less than 2 inches in width, and a hemmed bottom. The garment also has an embroidered logo with spangles on the front panel.

Although you have suggested that the garment be classified as a pullover in heading 6110, it is more specifically classified in heading 6109 as a tank top, based on the terms of the heading.

We are returning your samples as you requested.

The applicable subheading for the tank top, Style #H313 will be 6109.10.0060, Harmonized Tariff Schedule of the United States (HTSUS), which provides for women's tank tops and similar garments, knitted or crocheted, of cotton, women’s, tank tops. The rate of duty will be 16.5% ad valorem.

The tank top, Style #H313, falls within textile category 339. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. The textile category number above applies to merchandise produced in non-WTO member-countries. Quota and visa requirements are the result of international agreements that are subject to frequent renegotiations and changes. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
