RE: The tariff classification of a hunting blind from China

Dear Mr. Moeller:

In your letter dated April 4, 2007, you requested a tariff classification ruling on behalf of your client, Double Bull Archery, of Big Lake, Minnesota.

The submitted sample is a hunting blind that is identified as “Double Bull Blinds.” Its packaging indicates that it is constructed of cotton poly blended textile fabric and supported by a fiberglass framework. It features a roof with a center height of 67”, and 5” x 5” (25 square feet) of floor space. The blind weighs 17.5 lbs. and is secured by four wall and four corner stake rings. It has four shooting ports.

The applicable subheading for the hunting blinds will be 6306.22.9030, Harmonized Tariff Schedule of the United States (HTSUS), which provides for tents: of synthetic fibers: Other, other. The rate of duty will be 8.8% ad valorem.

Subheading 6306.22.9030 falls within textile category 669. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. The textile category number above applies to merchandise produced in non-WTO member-countries. Quota and visa requirements are the result of international agreements that are subject to frequent renegotiations and changes. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
