RE: The tariff classification of a woman’s jumper from China

Dear Ms. Mendoza:

In your letter dated April 3, 2007 you requested a classification ruling.

Style F40U6 is a woman’s pullover jumper constructed of 85 percent silk 15 percent cashmere knit fabric. The garment extends from the neck to the mid thigh. The garment features short raglan sleeves with rib knit cuffs, a rib knit bottom, a deep notched rib knit neckline which extends below the bust and a self fabric belt. The garment does not have sufficient bust coverage.

The jumper and belt are sold together at retail as a unit. They are adapted to each other, are mutually complementary and together form a whole that would not normally be offered for sale in separate parts. As such, they meet the definition of a composite good found in the Explanatory Notes to the General Rules of Interpretation, 3(b). The essential character of style F40U6 is imparted by the jumper.

The applicable subheading for style F40U6 composed of jumper and belt will be 6114.90.1030, Harmonized Tariff Schedule of the United States (HTSUS), which provides for Other garments, knitted or crocheted: Of other textile materials: Containing 70 percent or more by weight of silk or silk waste: Jumpers. The duty rate will be 0.9% ad valorem.

Style F40U6 composed of jumper and belt falls within textile category 759.
