RE: The tariff classification of a lamp from China.

Dear Mr. Salvato:

In your letter dated March 23, 2007, you requested a tariff classification ruling on behalf of your client, Team Beans LLC.

The merchandise under consideration is a Sport Lamp, Style LPMBSQ. A sample of the lamp was submitted with your ruling request and will be returned to you.

The Sport Lamp is advertised as a Squeezable Night Light. This lamp is a translucent rubberized squeezable ball in the design of a baseball with simulated stitching and a team logo from a major league baseball team. The ball measures approximately seven inches in diameter and sits on a four inch round plastic base for placement onto a flat surface. The base features a 120V (Volt) five foot power cord with a two prong polarized plug and an in-line rotary on/off switch.

The applicable subheading for the Sport Lamp will be 9405.20.8010, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Lamps and lighting fittingsnot elsewhere specified or includedElectric table, desk, bedside or floor-standing lamps: Other: Household.” The general rate of duty will be 3.9 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
