RE: The tariff classification of a safety vest from China.

Dear Mr. Oliver:

In your letter dated March 13, 2007 you requested a classification ruling.

The submitted picture is that of a safety vest made of woven 100% polyester fabric. The vest has fluorescent tape across and down the front and a hook and loop closure at the front.

 The applicable subheading for the safety vest will be 6217.10.9530, Harmonized Tariff Schedule of the United States (HTSUS), which provides for "Other made up clothing accessories; parts of garments or of clothing accessories, other than those in heading 6212: Accessories: Other: Other, Of man-made fibers." The duty rate will be 14.6% ad valorem. The textile category designation is 659.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
