RE: The tariff classification of woman’s pullover.

Dear Ms. Chioccola:

In your letter dated March 2, 2007 you requested a classification ruling. As requested, your samples are being returned to you.

The submitted sample, style 11235, is a woman’s pullover designed to simulate a knitted shirt worn over a camisole. The garment front consists of two layers with the outer layer simulating a shirt constructed of a 100% cotton 2 x 2 ribbed knit fabric and a full interior panel for the camisole portion made of a 100% cotton jersey fabric. The inner panel has a crocheted trimmed straight neckline with spaghetti straps while the outer panel has a rounded neckline that can close by means of an 8-snap partial front opening. The garment also features ¾ length hemmed sleeves and a hemmed bottom.

The applicable subheading for the pullover will be 6110.20.2079, Harmonized Tariff Schedule of the United States (HTSUS), which provides for sweaters, pullovers, sweatshirts, waistcoats (vests) and similar articles, knitted or crocheted: of cotton: other: other: other: women’s or girls’: other. The duty rate will be 16.5%.

The pullover falls within textile category 339. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. The textile category number above applies to merchandise produced in non-WTO member-countries. Quota and visa requirements are the result of international agreements that are subject to frequent renegotiations and changes.
