RE: The tariff classification of a costume from China.

Dear Mr. Greenberg:

In your letter dated February 23, 2007, you requested a tariff classification ruling.

You submitted the following textile costume assortment, which meets the flimsy requirements for classification within Chapter 95 and is being returned upon your request.

Item 61909, Disney Fairies Dress Up Set Assortment, is an assortment of three textile costumes that are exactly the same except for color and consist of a skirt, wings and shoes, with the skirt imparting the essential character. Although the skirt has a styling feature, a well-made waist and a well-made embellishment, it has flimsy seams, a flimsy hook and loop tab closure, flimsy edges on all skirt layers and flimsy edges at the closure.

The applicable subheading for item 61909, Disney Fairies Dress Up Set Assortment, will be 9505.90.6000, Harmonized Tariff Schedule of the United States (HSTUS), which provides for “Festive, carnival or other entertainment articles, including magic tricks and practical joke articles; parts and accessories thereof: Other: Other.” The rate of duty will be Free.
