RE: The tariff classification of plasma display monitors from Korea.

Dear Ms. Jarvis:

In your letter dated February 20, 2007, you requested a tariff classification ruling.

The subject merchandise, based on the submitted information, is 42-inch, 50-inch, and 60-inch TFT plasma color HD-display monitors, model numbers PMCP 642, PMCP 650, and PMCP 660, respectively, which are imported specifically for use in CCTV (closed-circuit television) camera systems. Each of these models, having picture-in-picture capability, incorporates audio input/output interfaces, as well as the following video input/output interfaces: DVI Input, RGB (VGA) Input, Component Input, S-Video Input, Composite Video Input/Output, and Video 1, 2 Input/Output. These monitors, which are NTSC/PAL compatible, do not contain a tuner and do not incorporate a video recording or reproducing apparatus. It is stated that these monitors will utilize VGA and DVR cables for use with a video security device or a computer and that these monitors are installed with multi-viewers for displaying up to 60 images; furthermore, these monitors can be hooked up to such products as multiplexers, digital video recorders, or wireless transmitters/receivers.

It is indicated that these monitors, with a screen aspect ratio of 16:9, support the following categories of video formats: 480i, 480p, 576p, 576i, 720p, and 1080i. Each model has a horizontal frequency of 31 kHz to 68 kHz and a vertical frequency of 25 Hz to 85 Hz. The display pitch sizes for models PMCP 642, PMCP 650, and PMCP 660 are indicated to be 0.900 x 0.676 mm, 0.810 x 0.810 mm and 0.966 x 0.966 mm, respectively; the native resolution for models PMCP 650 and PMCP 660 is 1366 x 768 (WXGA), while the native resolution for model PMCP 642 is 1024 x 768 (XGA).

It is noted that this merchandise will be imported with cables and power cords, as well as a remote control unit and a stand for the monitor, all of which, at the time of importation, will be put up in a manner suitable for sale directly to the dealer or system integrator for use in a CCTV application without repacking.

Since these monitors are stated to be designed for use with closed-circuit television camera systems, you believe these plasma display monitors should be properly classified under subheading 8528.51.00, Harmonized Tariff Schedule of the United States (HTSUS), which provides for Monitors and projectors, not incorporating television reception apparatus; reception apparatus for television, whether or not incorporating radiobroadcast receivers or sound or video recording or reproducing apparatus: Other monitors: Of a kind solely or principally used in an automatic data processing system of heading 8471.

However, based on the submitted information, it has been determined that this merchandise is designed to function as multi-media monitors in accepting both video and computer signals; therefore, consideration of classification under subheading 8528.51.00, HTS, is precluded since these monitors are not of the kind solely or principally used in an automatic data processing system.

The applicable subheading for these plasma display monitors will be 8528.59.3010, Harmonized Tariff Schedule of the United States (HTSUS), which provides for Monitors and projectors, not incorporating television reception apparatus; reception apparatus for television, whether or not incorporating radiobroadcast receivers or sound or video recording or reproducing apparatus: Other monitors: Other: Color: With a flat panel screen: Other: Other: Plasma-type. The rate of duty will be 5 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
