RE: The tariff classification of CD bins from China

Dear Ms. Davidson:

In your letter dated February 12, 2007, you requested a tariff classification ruling.

The submitted sample is identified as a Portofino CD Bin. The larger version is identified as Item number SKU# 10040933 and the smaller version is identified as SKU #10040934. The sample measures approximately 17½”W x 8”H x 6¼”D and is constructed of paperboard. It has a 2” faux leather border around the top that is actually plastic sheeting. The bottom half is black and white knit tweed fabric and the interior is lined with textile fabric. There are cut-out handles on both ends. The larger model accommodates up to 37 CDs and the smaller one holds up to 21 CDs.

The essential character of the bins is imparted by the textile fabrics.

The applicable subheading for the CD bins will be 6307.90.9889, Harmonized Tariff Schedule of the United States (HTSUS), which provides for other made up textile articles, other. The rate of duty will be 7% ad valorem.
