RE: The tariff classification of the “Soiled Linen Collection Hampers” from China.

Dear Mr. Anderson:

In your letter dated January 25, 2007, on behalf of Tri-State Hospital Supply Corporation, you requested a tariff classification ruling.

Photographs and descriptive literature were provided with your letter. The Soiled Linen Collection Hampers are used in hospitals to collect and dispose of soiled linens and infectious and non-infectious waste materials. The hampers are made of tubular steel and are designed to accept specially made plastic disposable bags that hang inside the hamper. The lids, which will not be imported with the hampers, are made of polypropylene plastic. A foot pedal on the hamper opens and shuts the hamper to seal in odors. The hampers are floor standing and have four wheels, enabling them to be moved short distances with ease. The hampers are available in three sizes. The large hamper measures 37 ¾ inches in height by 18 ½ inches in width by 19 ½ inches in depth. The medium hamper measures 32 ¾ inches in height by 18 ½ inches in width by 19 ½ inches in depth. The small hamper measures 25 ¾ inches in height by 18 ½ inches in width by 19 ½ inches in depth. Although the lids will not be imported with the hampers, the hampers as imported have the essential character of the complete article.

The applicable subheading for the hampers will be 9402.90.0020, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Medical, surgical, dental or veterinary furniture... Other." The rate of duty will be Free.

Duty rates are provided for your convenience and are subject to change. The text of the most recent HTSUS and the accompanying duty rates are provided on World Wide Web at http://www.usitc.gov/tata/hts/.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).

A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported. If you have any questions regarding the ruling, contact National Import Specialist Lawrence Mushinske at 646-733-3036.
