RE: The tariff classification of a flat braid, for use in the ornamentation of dolls, from China.

Dear Mr. Shih:

In your letter dated January 23, 2007, you requested a classification ruling.

The instant sample, which was identified as style #0206-178 (PC300R), consists of a flat braid, which is composed of 100% cotton. The braid is of the usual plaited construction and measures approximately ½" in width. This braid will be used as a decorative ribbon in such things as dolls. While not specifically mentioned in your letter, it is presumed that this material will be imported as piece goods.

The applicable subheading for the braid will be 5808.10.7000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for braids in the piece, of cotton or man-made fibers. The duty rate will be 7.4 percent ad valorem.

This merchandise falls within textile category 229. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise, which is the product of World Trade Organization (WTO) member countries. The textile category number above applies to merchandise produced in non-WTO member-countries. Quota and visa requirements are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information on quota and visa requirements applicable to this merchandise, we suggest you check, close to the time of shipment, the “Textile Status Report for Absolute Quotas” which is available on our web site at www.cbp.gov. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
