RE: The tariff classification of Teacher’s Pen kit from China

Dear Mr. Nicholas:

In your letter received January 26, 2007, you requested a tariff classification ruling.

You are requesting the tariff classification on a product that is identified as a ballpoint pen kit. The kit contains the following components: 3 brass tubes, 2 ink refills, 2 twist mechanisms, 2 plated pen tips, 2 refill guides and 2 plated bands. The foregoing parts will be packaged together in a zip lock plastic bag. The kit contains everything needed to make a ballpoint pen.

The applicable subheading for the Teacher’s Pen kit will be 9608.99.4000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for ball point pens; felt tipped and other porous-tipped pens and markersother: parts of articles provided for in subheadings 9608.10, 9608.31 and 9608.39 (other than balls for ball point pens). The rate of duty will be free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
