RE: The tariff classification of a ladies’ blouse from China

Dear Mr. McCauley:

In your letter dated January 16, 2007, you requested a classification ruling on behalf of bebe studio, inc. The submitted sample will be returned to you.

Submitted sample, style #S92851029500, is a ladies’ blouse constructed from both woven and knit fabric. The upper part of the garment is constructed from 80% rayon and 20% spandex knit fabric. The lower part of the garment is constructed from 95% silk and 5% spandex woven charmeuse fabric. The pullover garment is sleeveless with shoulder coverage of one and half inch wide. The garment features an empire waist, a self-covered button on each shoulder and a round neckline.

The woven component imparts the essential character of the garment; therefore, the garment will be classified based upon GRI 3(b), which states that garments will be classified by the component, which gives them their essential character. As such, the garment is classified as a woman’s woven blouse under heading 6211, HTS.

The applicable subheading for style S92851029500 will be 6211.49.1050, Harmonized Tariff Schedule of the United States (HTSUS), which provides for track suits, ski-suits and swimwear; other garments: other garments, women’s or girls’: of other textile materials: containing 70 percent or more by weight of silk or silk waste: blouses, shirts and shirt-blouses, sleeveless tank styles and similar upper body garments excluded from heading 6206. The duty rate will be 1.2 percent ad valorem.
