RE: The tariff classification of “milk chocolate” (product number 11-0188) from Canada

Dear Mr Forbes:

In your letter dated January 10, 2007 you requested a tariff classification ruling.

The subject merchandise is stated to contain 51.06 percent sugar, 18.13 percent chocolate liquor, 17.31 percent cocoa butter, 8.74 percent non-fat dry milk, 3.46 percent anhydrous milkfat, 0.73 percent cocoa powder, 0.49 percent soya lecithin, and 0.04 percent vanillin. The product contains a total milkfat content of 3.55 percent, and a total milk solids content of 12.20 percent. The product will be shipped in solid one-ton blocks. The product is for use in coating cakes and pastries.

The applicable subheading for the milk chocolate, will be 1806.20.9900, Harmonized Tariff Schedule of the United States, Annotated, (HTSUS), which provides for chocolate and other food preparations containing cocoa...other preparations...in liquid, paste, powder, granular or other bulk form in containers or immediate packings, of a content exceeding 2 kg...other...other...other. The rate of duty will be 8.5 percent ad valorem.
