RE: The tariff classification of a water filter from an unspecified country.

Dear Ms. Hachmann:

In your letter dated January 2, 2007, you requested a tariff classification ruling. The submitted sample will be returned to you as requested.

The merchandise under consideration is the E0085 Water Treatment System Replacement Filter. It is a cylinder which measures approximately 7.25” long by 4.125” in diameter, and consists of a filter sandwiched between two plastic endcaps. The filter features a thin outer layer of textile wrapped around a layer of active carbon. The filter cartridge is designed to be used in the Gen IV Water Treatment System.

The applicable subheading for the E0085 Water Treatment System Replacement Filter will be 8421.21.0000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for: Centrifugesfiltering or purifying machinery and apparatus, for liquids or gases: Filtering or purifying machinery and apparatus for liquids: For filtering or purifying water. The general rate of duty will be Free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
