RE: The tariff classification of pipe conveyor belting, from Norway.

Dear Mr. Paul:

In your letter dated November 28, 2006, which was a follow-up to an earlier inquiry where we requested additional information, you requested a tariff classification ruling.

While no representative sample could be practically submitted, you forwarded some descriptive literature as well as a synopsis of answers to our questions.

The belting in question is for use on pipe conveyors and is of a vulcanized rubber construction, which contains polyester and/or polyamide man-made fiber reinforcement for longitudinal stability. Specifically, you state in your correspondence, that the belting will have four plies with no steel breakers (generally used for lateral stiffness) and will measure between 600 mm and 2,500 mm wide. While the lengths may be in hundreds or thousands of feet, you indicate that the material will be imported in rolls for subsequent cutting to length and then joining together to form a closed loop belt here in the United States. You state in your literature that one method of accomplishing this may be by “vulcanizing” the ends of the belt sections after importation. Finally, the finished belts will be mounted on the appropriate machine or apparatus for their respective conveyance applications.

The applicable subheading for the product will be 4010.12.9000 Harmonized Tariff Schedule of the United States (HTSUS), which provides for conveyor belts or belting, reinforced only with textile materials, combined with a single textile material, other. The duty rate will be 1.9 percent ad valorem.
