RE: The tariff classification of “Designer’s World” video game from China.

Dear Ms. Rose:

In your letter dated November 30, 2006, you requested a tariff classification ruling.

The “Designer’s World” game consists of a game console, a game remote and instruction book. The game console is connected to a television, or to its VCR or DVD player, and pop up screens guide the player through the game play. The player is challenged to design her own line of clothing, select models to show off the designs, and manage the business with the goal of impressing judges at fashion shows and gaining success for your line. The sample will be returned at your request.

The applicable subheading for the “Designer’s World” video game will be 9504.10.0000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Articles for arcade, table or parlor gamesVideo games of a kind used with a television receiver and parts and accessories thereof.” The rate of duty will be free.

Duty rates are provided for your convenience and are subject to change. The text of the most recent HTSUS and the accompanying duty rates are provided on World Wide Web at http://www.usitc.gov/tata/hts/.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported. If you have any questions regarding the ruling, contact National Import Specialist Tom McKenna at 646-733-3025.
