RE: The tariff classification of textile pads, towel and plastic gripper from China

Dear Ms. Messenger:

In your letter dated December 10, 2006 you requested a classification ruling on behalf of Carrand Companies Inc.

You submitted four samples. Item 40122/RC-443 “The Gripper” is a 3-Pack of applicator pads used to apply wax and polish to automobiles. The circular pads are made from a piece of plastic foam covered entirely with terry knit man-made fiber fabric. The edges of the pads are finished with an overlock stitch. Included with the pads is a removable plastic handle with a gripper base. When pressed against the terry cloth applicator pad the hook-like gripper base attaches to the pad.

Item RC-445, described as a plastic gripper, is a plastic handle with a gripper base. When pressed against the terry cloth applicator pad, the hook-like gripper base attaches to the looped terry fabric, holding the pad in place.

Item RC-444 is a circular micro fiber pad used to apply wax and polish to automobiles. The pad is comprised of a plastic foam circular pad covered with man-made fiber fabric. The edges are finished with an overlock stitch.

Items RC-441 and RC-446 are a 2-Pack of micro fiber towels. Both towels measure 12 x 16 inches. They are made from 80 percent polyester and 20
percent polyamide fabric. All of the edges are finished. The towels are used to clean automotive glass and mirrors.

The applicable subheading for Items RC-441 and RC- 446 will be 6307.10.2030, Harmonized Tariff Schedule of the United States (HTSUS), which provides for other made up articles, including dress patterns: floorcloths, dishcloths, dusters and similar cleaning cloths: otherother. The rate of duty will be 5.3 percent ad valorem.

The applicable subheading for Items 40122/RC-43 and RC-444 will be 6307.90.9889, HTSUS, which provides for other made up articles, including dress patterns: other: other: otherother: other. The duty rate will be 7 percent ad valorem.

The applicable subheading for the plastic gripper handle Item RC-445, will be 3926.90.2500, HTSUS, which provides for other articles of plastics...handles and knobs, not elsewhere specified or included, of plastics. The general rate of duty will be 6.5 percent ad valorem.

Subheadings 6307.10.2030 and 6307.90.9889 are not assigned a category designation and items classified therein are not subject to quota or visa requirements.
