RE: The tariff classification of a costume from China.

Dear Ms. Huang:

In your letter dated November 22, 2006, on behalf of Sears Holdings Global Sourcing Ltd., you requested a classification ruling. The sample will be returned to you.

Your submitted samples, Style# W-1914-00, is a woman’s Medieval Cape Costume. The well-made costume consists of a dress and a hooded cape. The dress is constructed of knit polyester fabric. The dress has a well-made neck and seams and turned armholes. The cape is constructed of knit nylon with a small amount of metalized strip that is separate and distinct from the other yarns that comprise the fabric. The cape has a well-made neck and finished edges.

Style # W-1914-00 consist of two or more garments. Note 13 of Section XI, of the HTSUS, requires that textile garments of different headings be separately classified, thus preventing classification of costumes consisting of two or more garments as sets. If a set cannot exist by application of Note 13, the articles that may be packaged with the garments must also be classified separately.

The applicable subheading for the style # W-1914-00 dress will be 6104.43.2010, Harmonized Tariff Schedule of the United States (HTSUS), which provides for provides for women’s or girls’ suits, ensembles, suit-type jackets, blazers, dresses, . . . knitted or crocheted: dresses: of synthetic fibers: other, woman’s. The duty rate will be 16 percent ad valorem.

The applicable subheading for the style # W-1914-00 cape will be 6114.30.3070, Harmonized Tariff Schedule of the United States (HTSUS), which provides for other garments, knitted or crocheted: of man-made fibers: other, other: women’s or girls’. The duty rate will be 14.9 percent ad valorem.

Style # W-1914-00 dress falls within textile category designation 636. Style # W-1914-00 cape falls within textile category designation 659. The textile category number above applies to merchandise produced in non-WTO member-countries.
