RE: The tariff classification of “Semi-sweet Chocolate, dry stock” (Product number 0753190-045) from Canada

Dear Mr. Forbes:

In your letter dated September 13, 2006, on behalf of Barry Callebaut Canada, of Hyacinthe, Quebec, you requested a tariff classification ruling.

The subject merchandise is stated to contain 56.23 percent sugar, 43.76 percent cocoa liquor. You indicate that the product will be shipped in powder form. It will be shipped in 45-pound cases for use in baking.

The applicable subheading for the product “Semi-sweet Chocolate, dry stock”, if imported in quantities that fall within the limits described in additional U.S. note 1 to chapter 18, will be 1806.20.5000, Harmonized Tariff Schedule of the United States Annotated (HTSUS), which provides for chocolate and other food preparations containing cocoa: Other preparationsin liquid, paste powder, granular or other bulk form in containers or immediate packings, of a content exceeding 2 kg: Preparations consisting wholly of ground cocoa beans, with or without added cocoa fat, flavoring or emulsifying agents, and containing not more than 32 percent by weight of butterfat or other milk solids and not more than 60 percent by weight of sugar: Other: Other. The general rate of duty will be 4.3 percent ad valorem.
