RE: The tariff classification of Playstation Portable gaming machine accessories from China

Dear Ms. Carey:

In your letter dated September 12, 2006, you requested a tariff classification ruling.

You are requesting the tariff classification on two products that are identified as follows: Model RTPSP11 and Model PSC99. Model RTPSP11 is an aluminum case that is specially fitted to house the Sony PSP (Playstation Portable gaming machine). The case also acts as a docking station and includes two hi-fidelity speakers as well as a rechargeable lithium-ion battery. Model PSC99, PSP Nodus Sound Dock, is also a product that is specially fitted for the Playstation Portable gaming machine (PSP). The sound dock incorporates two high-end speakers that reside on either side of the docking station opening. The Sound Dock is adjustable for different viewing angles and also acts as a charger when power is received from an outside source. The PSP Sound Dock includes a remote control which operates the Sound Dock and the PSP, and an auxiliary input cable for use with other audio devices such as MP3 players. Detailed illustrations were included.

The applicable subheading for Model RTPSP11 and Model PSC99, accessories for the Playstation Portable gaming machine, will be 9504.90.4000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for articles for arcade, table or parlor gamesparts and accessories thereof: other: game machines, other than those operated by coins, banknotes (paper currency), discs or similar articles; parts and accessories thereof. The rate of duty will be free.

Duty rates are provided for your convenience and are subject to change. The text of the most recent HTSUS and the accompanying duty rates are provided on World Wide Web at http://www.usitc.gov/tata/hts/.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).

A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported. If you have any questions regarding the ruling, contact National Import Specialist Tom McKenna at 646-733-3025.
