RE: The tariff classification of a logic fuse board, the country of origin was not stipulated.

Dear Mr. Roll:

In your letter dated June 5, 2006, on behalf of your client Alcatel Submarine Networks (ASN), you requested a tariff classification ruling.

The merchandise under consideration is the Alcatel Logic Fuse Board. The fuse board is a replaceable modular unit measuring approximately ¾” x 5” x 7½”. From the information you provided, the Logic Fuse Board is a plug-in module for submarine Power Feed Equipment (PFE), a system designed to power undersea repeatered cable network systems. The Logic Fuse Board module distributes electricity to various units within the system and houses fuses to protect the circuitry from excess current caused by faults on the control and monitoring circuits. The fuse board contains additional circuitry for connecting to an alarm unit that logs and displays fuse failures to the operator. The Logic Fuse Board is rated for use in 5 to 12 volt systems.

The applicable subheading for the Alcatel Logic Fuse Board will be 8537.10.9050, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Boards, panels, consolesand other bases, equipped with two or more apparatus of heading 8535 or 8536, for electric control or the distribution of electricityFor a voltage not exceeding 1,000 V: Other: Other: Panel boards and distribution boards.” The general rate of duty will be 2.7 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
