RE: The tariff classification of a rubber door stopper from China

Dear Mr. Crago:

In your letter dated April 19, 2006, on behalf of Corporate Express, you requested a tariff classification ruling.

The illustration depicts wedge shaped door stoppers. Item C097CA00066 measures 12 cm in length by 5.2 cm in width by 3.8 cm in height. Item C097CA00067 (brown) and C097CA00068 (orange) measure 15 cm in length by 8.8 cm in width by 5.1 cm in height. You have stated that all of the door stoppers are made of natural rubber. These door stoppers are of a kind principally used in offices and commercial buildings.

The applicable subheading for the door stoppers, when made of natural rubber, will be 4016.99.3500, Harmonized Tariff Schedule of the United States (HTSUS), which provides for other articles of vulcanized rubber other than hard rubber: other: of natural rubber: other. The rate of duty will be free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
