RE: The tariff classification of a cosmetic cooler from China

Dear Ms. Masternak:

In your letter dated January 25, 2006 you requested a tariff classification ruling on behalf of your client Cinmar, LP.

The cosmetic cooler is a refrigerated unit that stores cosmetics. It is approximately 12 inches high, 10.25 inches deep and 7.5 inches wide weighing 4.7 pounds. It is designed to be placed on a counter top and is not recommended for food use. It is an absorption type, electrical refrigerator that holds 5 litres. It contains a semi-conductor, which keeps the temperature constant at 53.6 degree Fahrenheit. The applicable subheading for the cosmetic cooler will be 8418.61.0075, Harmonized Tariff Schedule of the United States (HTSUS), which provides for Refrigerators, freezers and other refrigerating or freezing equipment, electric or other; heat pumps, other than the air conditioning machines of heading 8415; parts thereof (con.): Other refrigerating or freezing equipment; heat pumps: Other: Other refrigerating or freezing equipment: Other. The rate of duty will be free.
