RE: The tariff classification of a costume from China.

Dear Mr. Greenberg:

In your letter dated November 22, 2006, you requested a tariff classification ruling.

You have requested a ruling on the following textile costume, which meets the flimsy, non-durable requirements for classification within Chapter 95 and is being returned upon your request.

Item 89478, Barbie Bride Dress, is a textile costume comprised of a dress. Although the dress has four styling features (pleats and multiple layer skirt, front and straps) and well-made edges at the arms, it has a flimsy neck, waist and seams, flimsy thin elastics on the back, a flimsy hook and loop tab closure and flimsy edges at the bottom and closure.

The applicable subheading for item 89478, Barbie Bride Dress, will be 9505.90.6000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Festive, carnival or other entertainment articles, including magic tricks and practical joke articles; parts and accessories thereof: Other: Other." The rate of duty will be Free.
