RE: The tariff classification of a bottle bag from China

Dear Ms. Chen:

In your letter dated September 26, 2006, you requested a tariff classification ruling on behalf of your client, Pan Pacific Plastics Mfg., Inc.

The submitted sample is a carrying bag specially fitted to contain four bottles. It is wholly made-up of non-woven polypropylene man-made fiber textile material. It is unlined and measures approximately 8.5"(H) x 10"(W) x 10.5"(D). It is suitable for repetitive reuse.

The applicable subheading for the bottle bag will be 4202.92.9026, Harmonized Tariff Schedule of the United States (HTSUS), which provides for other containers and cases, other, with outer surface of textile materials, of man-made fibers. The rate of duty will be 17.6% ad valorem.

HTSUS 4202.92.9026 falls within textile category designation 670. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. The textile category number above applies to merchandise produced in non-WTO member-countries. Quota and visa requirements are the result of international agreements that are subject to frequent renegotiations and changes.
