RE: The tariff classification of a woman’s shirt from El Salvador.

Dear Mr. Nagel:

In your letter dated September 29, 2006, you requested a classification ruling for a woman’s shirt. The garment will be returned, as requested.

Style 035X is a woman’s shirt constructed of 100% cotton knit pique fabric with more than ten stitches in both the horizontal and vertical directions. The shirt has a collar, a partial front opening with a four-button closure, short sleeves and a plain, hemmed bottom.

The applicable subheading for style 035X will be 6106.10.0010, Harmonized Tariff Schedule of the United States (HTSUS), which provides for Women’sshirts, knitted or crocheted: Of cotton. The rate of duty will be 19.7% ad valorem.

The shirt falls within textile category 339. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. The textile category number above applies to merchandise produced in non-WTO member-countries. Quota and visa requirements are the result of international agreements that are subject to frequent renegotiations and changes.
