RE: The tariff classification of a women’s jacket from Sri Lanka

Dear Ms. Boullet:

In your letter dated September 28, 2006, you requested a classification ruling. The sample you submitted will be returned as you requested.

The item in question, style AL7021, is a women’s unlined outerwear jacket with a shell made from a 98% cotton/2% elastane woven twill fabric, with a small amount of 98% cotton/2% elastane corduroy fabric on the shoulders, the back yoke, elbow patches and pocket trim. The jacket has a full front opening with an exposed zipper closure that extends to the top of the rounded collar, long sleeves with cuffs, a banded bottom and pockets at the waist with flaps secured by a tab with a snap. The collar, cuffs, waistband and pocket tabs have multiple rows of parallel stitching.

The applicable subheading for the jacket will be 6202.92.2061, Harmonized Tariff Schedule of the United States (HTSUS), which provides for other women’s anoraks (including ski-jackets), windbreakers and similar articles, of cotton. The duty rate will be 8.9 percent ad valorem.

Duty rates are provided for your convenience and are subject to change. The text of the most recent HTSUS and the accompanying duty rates are provided on World Wide Web at http://www.usitc.gov/tata/hts/.
