RE: The tariff classification of a woman’s dress from China

Dear Ms. Fox:

In your letter dated September 22, 2006, you requested a classification ruling on behalf of Tellas Ltd. The submitted sample will be returned to you as requested.

Style S71DW230 is a woman’s dress constructed from 100 percent cotton woven fabric. The dress features long sleeves with buttoned cuffs, a collar, two zippered chest pockets, tabs at the waist, two front zippered pockets below the waist and a full front zippered opening with a button and loop closure at the neck. The sleeves can be rolled up and fastened with a buttoned tab. The dress extends to mid thigh.

The applicable subheading for the dress will be 6204.42.3050, Harmonized Tariff Schedule of the United States (HTSUS), which provides for women’s or girls’ suits, ensembles, suit-type jackets, blazers, dresses, skirts, divided skirts, trousers, bib and brace overalls, breeches and shorts (other than swimwear): dresses: of cotton: other: other: other: other: women’s. The duty rate will be 8.4 percent ad valorem.

Style S71DW230 falls within textile category 336. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries.
