RE: The tariff classification of socks from China.

Dear Mr. Price:

In your letter dated August 16, 2006, you requested a classification ruling.

The submitted sample style SANKLE is a pair of men’s ankle socks. You state that the socks are made of 93% bamboo/7% spandex. For purposes of this ruling, we are assuming that what you call bamboo is actually an artificial fiber, which is derived from bamboo.

The applicable subheading for the men’s ankle socks, style SANKLE will be 6115.99.1820, Harmonized Tariff Schedule of the United States (HTSUS), which provides for "Panty hose, tights, stockings, socks and other hosiery, including stockings for varicose veins, and footwear without applied soles, knitted or crocheted: Other: Of other textile materials: Of artificial fibers: Other, Other." The duty rate will be 14.6 percent ad valorem. The textile category designation is 632.
