RE: The tariff classification of a “Citrus Juicer” from China and a “Chef’s Cutting Guard” from China

Dear Ms. Ramsey:

In your letter dated August 10, 2006, you requested a tariff classification ruling.

The items you describe are as follows:

A “Citrus Juicer,” item 56620, is comprised of 18/8 stainless steel. The item measures 1 ½” in length, 1 ½” in width, and 278” in height. The juicer is used to extract juice from citrus fruit.

A “Chef’s Cutting Guard,” item 57360, is comprised of 18/8 stainless steel. The item measures 2 78” in length, 2 18” in width, and 78” in depth. The guard is used to keep food in place while being cut and also guards fingers from being cut.

The applicable subheading for the “Citrus Juicer” will be 8205.51.3030, Harmonized Tariff Schedule of the United States (HTSUS), which provides for handtools (including glass cutters) not elsewhere specified or included; blow torches and similar self-contained torches; vises, clamps and the like, other than accessories for and parts of machine tools; anvils; portable forges; hand- or pedal-operated grinding wheels with frameworks; base metal parts thereof: other handtools (including glass cutters) and parts thereof: household tools, and parts thereof: of iron or steel: other (including parts): other (including parts). The rate of duty will be 3.7%.

The applicable subheading for the “Chef’s Cutting Guard” will be 7323.93.0060, HTSUS, which provides for table, kitchen or other household articles and parts thereof, of iron or steel; iron or steel wool; pot scourers and scouring or polishing pads, gloves and the like, of iron or steel: other of stainless steel: cooking and kitchen ware: other: kitchen ware. The rate of duty will be 2%.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
