RE: The tariff classification of women’s woven apparel from China

Dear Mr. Russo:

In your letter dated August 14, 2006, you requested a classification ruling on behalf of Travelsmith Outfitters. The submitted sample will be returned to you, as requested.

Style TS-3324 consists of a women’s upper body garment and a matching pair of pant packaged together in a polybag. Both garments are made from a lightweight 100% polyester woven micro-suede fabric. The shirt features long hemmed sleeves, a band collar, two pockets located below the waist on either side of the full front zippered opening. The sleeve ends, pockets and front opening have a matching colored capping. The full-length pants feature an elasticized waistband, on-seam pockets and piping inserted in the side seams. You have stated that there will be some modifications in the production sample. This ruling is based on the submitted garments.

The applicable subheading for the shirt of style TS-3324 will be 6211.43.0060, Harmonized Tariff Schedule of the United States (HTSUS), which provides for other garments, women’s or girls’: of man-made fibers: blouses, shirts and shirt-blouses, sleeveless tank styles and similar upper body garments excluded from heading 6206. The rate of duty will be 16 percent ad valorem.

The applicable subheading for the pants of style TS-3324 will be 6204.63.3510, Harmonized Tariff Schedule of the United States (HTSUS), which provides for women’s trousers, of synthetic fibers, other, other, trousers and breeches, women’s. The duty rate will be 28.6% ad valorem

The shirt falls within textile category 641 and the pants within textile category 648. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. The textile category number above applies to merchandise produced in non-WTO member-countries. Quota and visa requirements are the result of international agreements that are subject to frequent renegotiations and changes.
