RE: The tariff classification of a plastic cube from China or Hong Kong.

Dear Ms. Powell:

In your letter dated July 24, 2006, on behalf of Florists’ Transworld Delivery, you requested a tariff classification ruling.

The sample provided with your letter is an open cube composed of molded polystyrene plastic. The shell is covered with cellular PVC plastic sheeting that is backed with a plain knit textile fabric for mere reinforcement. The PVC outer layer is decorated with two rows of contrasting colored stitching along the top. The cube measures approximately 5 inches in each dimension. You state that the container will be sold to florists for use in their arrangements. The container is of a class or kind that is principally used in the home for general-purpose storage.

The applicable subheading for the plastic open cube will be 3924.90.5500, Harmonized Tariff Schedule of the United States (HTSUS), which provides for tableware, kitchenware, other household articles and toilet articles, of plastics: other. The rate of duty will be 3.4 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
