RE: The tariff classification of a woman’s knit tank top from China.

Dear Ms. Fox:

In your letter dated August 7, 2006, you requested a classification ruling for a woman’s knit garments. The samples will be returned, as requested.

Style 440957 is a woman’s tank top constructed from 100 percent cotton rib knit fabric. The garment has a U-shaped neckline in front and back and ½ inch shoulder straps. The neckline, armholes, and bottom all have unfinished edges.

The applicable subheading for style 440957 will be 6109.10.0060, Harmonized Tariff Schedule of the United States (HTSUS), which provides for Tank tops knitted or crocheted: Of cotton: Women’s. The duty rate will be 16.5 percent ad valorem.

The tank top falls within textile category designation 339. Quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes.
