RE: The tariff classification of a woman’s pullover from China

Dear Mr. LoPresti:

In your letter dated July 18, 2006, you requested a classification ruling.

The submitted sample, style 01247H048A, is a woman’s cardigan constructed from 100 percent acrylic knit fabric. The garment features long sleeves with cuffs, a hood, two pockets at the waist, a loose fitting waistband and a full front zippered opening. The outer surface of the fabric measures more than 9 stitches per 2 centimeters in the direction that the stitches were formed. The components are cut and sewn.

The applicable subheading for style 01247H048A will be 6110.30.3059, Harmonized Tariff Schedule of the United States (HTSUS), which provides for sweaters, pullovers, sweatshirts, waistcoats (vests) and similar articles, knitted or crocheted: of man-made fibers: other: other: other: other: women’s or girls’: other. The duty rate will be 32 percent ad valorem.
