RE: The tariff classification of a woman’s knitted sweater from China.

Dear Ms. Marlowe:

In your letter dated June 27, 2006, on behalf of your client Sweater.Com, Inc., you requested a classification ruling. Your sample is being returned as requested.

The submitted sample, Style #22050 is a woman’s sweater constructed from 60% cotton, and 40% acrylic knit fabric (sections of the two front panels, the sleeves and the hood), and 97% cotton woven fabric, and 3% elastane fabric (the entire back panel, the plackets, and the front pockets). The garment features long sleeves, a hood, a full front opening with a six-button closure, two front pockets at the waist, two side tabs at the bottom, with a one-button closure, and a self-start bottom. The outer surface of the knit fabric measures fewer than 9 stitches per 2 centimeters in the direction that the stitches were formed. The essential character of Style #22050 is given by the knit fabric of the two front panels and the sleeves, Harmonized Tariff Schedule of the United States (HTSUS), General Rules of Interpretation (GRI), Rule 3, noted.

The applicable subheading for the sweater, Style #22050 will be 6110.20.2020, Harmonized Tariff Schedule of the United States (HTSUS), which provides for sweaters, knitted or crocheted, of cotton, other, other, sweaters, women’s. The rate of duty will be 16.5% ad valorem.

The sweater, Style #22050 falls within textile category designation 345. Quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes.
