RE: The tariff classification of a woman’s cardigan from China

Dear Ms. Purcell:

In your letter dated July 5, 2006, you requested a classification ruling. Your sample is being returned as requested.

The submitted sample, style number A66407, is a woman’s cut and sewn cardigan that is constructed from 90% polyester, 10% spandex velvet knit fabric. The outer surface of the fabric measures more than 9 stitches per 2 centimeters in the direction that the stitches were formed. The cardigan features a V-neckline, long hemmed sleeves, a full front opening with a hook and eye closure, and a hemmed bottom. The neckline, the front and back shoulder areas, the placket, the sleeve cuffs, and the bottom are finished with decorative stones and cording.

The applicable subheading for the cardigan will be 6110.30.3059, Harmonized Tariff Schedule of the United States (HTSUS), which provides for sweatersand similar articles, knitted: of man made fibers: otherother: women’s. The duty rate will be 32% ad valorem.

The cardigan falls within textile category designation 639. Quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes.
