RE: The tariff classification of a woman’s upper body garment from China.

Dear Ms. Cumins:

In your letter dated July 5, 2006, on behalf of your client Intertex Apparel, Ltd., you requested a classification ruling for a woman’s upper body garment.

The submitted sample, Style #46Z100, is a woman’s upper body garment constructed from 100% acrylic knit fabric. The garment features long sleeves, a hood, and a deep V-shaped front opening to the waist. The garment has shoulder coverage, but does not cover the bust.

We are returning your sample as you requested.

The applicable subheading for Style 46Z100 will be 6114.30.3070, Harmonized Tariff Schedule of the United States (HTSUS), which provides for other garments, knitted or crocheted of man-made fibers, other, other, women’s or girls’. The rate of duty will be 14.9% ad valorem.
