RE: The tariff classification of a bracelet, earrings and a choker from China.

Dear Mr. Coe:

In your letter dated June 28, 2006, you requested a tariff classification ruling.

The submitted samples are as follows:

SKU No. 716147 is a bracelet made of base metal covered with imitation fur made of polyester.

SKU No. 716146 consists of a pair of post earrings made of metal with a metal ornament that is covered with horsehair.

SKU No. 716145 is a metal choker with a metal pendant that is covered with horsehair.

The metal and the imitation fur used to construct the bracelet, and the metal and the horsehair used to construct the earrings and the choker, in each case form a composite good. When the essential character of a composite good can be determined, the whole product is classified as if it consisted only of the part that imparts the essential character to the composite good. In each case, the metal imparts the essential character to the good.

Your samples are being returned as requested.

The applicable subheading for the bracelet, SKU No. 716147, the earrings, SKU No. 716146, and the choker, SKU No. 716145, will be 7117.19.9000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Imitation jewelry: Of base metal, whether or not plated with precious metal Other.” The rate of duty will be 11% ad valorem.

Duty rates are provided for your convenience and are subject to change. The text of the most recent HTSUS and the accompanying duty rates are provided on World Wide Web at http://www.usitc.gov/tata/hts/.

You have also submitted a sample of a wristwatch with a Mother of Pearl face and a strap made of cowhide, SKU No. 716148. We cannot classify the watch without further information. Please provide the number of jewels in the movement. Also, what is the composition of the case? When this information is available, you may wish to consider resubmission of your request.  If you decide to resubmit your request, please resubmit a copy of your original letter along with the sample and additional information requested.

Please mail your request to U.S. Customs and Border Protection, Customs Information Exchange, 10th Floor, One Penn Plaza, New York, NY 10119, Attn: Binding Rulings Section.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).

A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported. If you have any questions regarding the ruling, contact National Import Specialist Lawrence Mushinske at 646-733-3036.
