RE: The tariff classification of a women’s sweatshirt from Macau

Dear Mr. Stack:

In your letter dated June 26, 2006, you requested a classification ruling on behalf of Avon Products, Inc.

Style PP 349484 is a women’s hooded sweatshirt made of 80% cotton and 20% polyester knit fabric that is napped on the inner surface. The outer surface of the garment measures more than 9 stitches per 2 centimeters in the horizontal direction. The sweatshirt features a hood, long sleeves with ribbed cuffs, a kangaroo pocket, a ribbed bottom, and a design print of Mickey Mouse on the front panel, as well as the name “Mickey” on the left sleeve. In your letter you state that Avon is an authorized user of the Mickey Mouse image.

The applicable subheading for style PP349484 will be 6110.20.2045, Harmonized Tariff Schedule of the United States (HTSUS), which provides for sweaters, pulloversand similar articles, knitted or crocheted: Of cotton: Other: Other: Sweatshirts: Women’s or girls’. The duty rate will be 16.5% ad valorem.
