RE: The tariff classification of tote bags from China

Dear Mr. Stein:

In your letter dated June 21, 2006, you requested a tariff classification ruling.

You submitted two tote bags, both said to be of 100% man-made fibers. Both bags are double-handle shopping bags designed to contain personal effects and accessories during travel.

The first is made of an undyed woven fabric with a design and lettering printed on it. It measures 17.5” high and 15.5” across. The second is a blue bag made of spun-bonded non-woven fabric that we assume is not coated in any manner. It measures 15.5” high x 17” across x 11” deep.

The applicable subheading for the tote/shopping bags will be 4202.92.3031, Harmonized Tariff Schedule of the United States (HTSUS), which provides for travel, sports and similar bags, with outer surface of textile materials, other, of man-made fibers, other. The duty rate will be 17.6 percent ad valorem.

HTS 4202.92.3031 falls within textile category designation 670. Quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes.
