RE: The tariff classification of hats from China.

Dear Ms. Hu:

In your letter dated June 14, 2006, you requested a classification ruling. As requested, the samples will be returned to you.

You have submitted five samples. Style 9877 is a knit watch-style cap of 100% acrylic knit fabric. The item is snug fitting.

Style 9903 is a knit watch-style cap made of 100% acrylic knit fabric. The cap features contrasting stripes on the turned up cuff.

Style 9905 is a hat with a visor constructed of knit 100% acrylic. The hat has an approximately 3-inch wide cuff and an approximately 2 ½-inch wide peak. The item is snug fitting.

Style 9906 is a knit watch-style cap made of 100% acrylic knit fabric. The striped cap features two tassels on the top of the crown. The item is snug fitting.

Style 9910 is a knit watch-style cap of 100% acrylic knit fabric. The item is snug fitting.

The applicable subheading for styles 9877,9903,9905, 9906 and 9910 will be 6505.90.6090, Harmonized Tariff Schedule of the United States (HTSUS), which provides for hats and other headgear, knitted or crocheted, or made up from lace, felt or other textile fabric. . . .: other: of man-made fibers: knitted or crocheted or made up from knitted or crocheted fabric: not in part of braid, other: other: other The duty rate will be 20 cents per kilogram plus 7 percent ad valorem.
