Dear Mr. Adams:

In your letter dated June 13, 2006, you requested a classification ruling. Your sample is being returned.

The submitted sample, style number 4741, is a woman’s sweater that is constructed from 100% acrylic 1x1 rib knit fabric. It extends to the mid-thigh area. The outer surface of the fabric measures 9 stitches per 2 centimeters in the direction that the stitches were formed. The sweater features a mock collar, ¾ inch long sleeves with turned back cuffs, a full front opening with 4 button closures, 2 front patch pockets below the waist, and a loose-fitting ribbed bottom.

This garment is a loose-fitting garment with a sweater stitch count and is specifically provided for in heading 6110, HTSUS.

The applicable subheading for the sweater will be 6110.30.3020, Harmonized Tariff Schedule of the United States (HTSUS), which provides for sweaters, knitted: of man made fibers: other: sweaters: women’s. The duty rate will be 32% ad valorem.

Duty rates are provided for your convenience and are subject to change. The text of the most recent HTSUS and the accompanying duty rates are provided on World Wide Web at http://www.usitc.gov/tata/hts/.

The sweater falls within textile category designation 646. Quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes.
